John Weatherspoon

IP Attorney

I provide the full range of Intellectual Property legal services, relating to patent, trademark, trade secret and copyright protection for clients.  I also regularly advise clients on strategies for monetizing and capitalizing on their Intellectual Property assets.  As an experienced business, corporate and intellectual property attorney, I provide in-depth experience advising individual clients, companies, and corporate legal departments across a wide range of industries. I have extensive experience counseling clients on developing their intellectual property portfolios; and preparation, prosecution and management of U.S. and foreign patent dockets.

Additionally, I provide intellectual property counseling and strategic research for clients, and enforce intellectual property rights, e.g., through licensing, litigation, settlement, etc).  I also provide competitor intelligence for clients, and also conduct patentability, freedom to operate, infringement, validity and product clearance analyses for clients.

In addition, I have broad experience handling a wide range of litigation matters for clients.  For example, I have had significant involvement with a number of patent litigation cases in federal district courts and before the International Trade Commission (I.T.C.), and also at the federal appellate level, before the U.S. Court of Appeals for the Federal Circuit.

In addition to my litigation experience, I have extensive experience providing other intellectual property services for clients. For instance, I have a lot of experience with ex parte reexamination of third-party patents. I regularly assist clients with strategic issues involving the acquisition, development, patenting, leveraging, and monetization of their intellectual property. I also regularly assist clients by preparing non-disclosure agreements, collaboration agreements and material transfer agreements; monitoring the intellectual property activities of third parties; preparing licensing agreements for client; and handling intellectual property due diligence for clients.
